When community and strata schemes were introduced, what was envisaged was a few houses on commonly owned land or a unit apartment building of a dozen units. In 2025, we now have strata schemes with hundreds of units, sometimes occupying more than one building. Then there are buildings occupied by several separate stratum with shared facilities that is managed by a building management committee (BMC) under a strata management statement (SMS). Large-planned developments with tiered structures of neighborhood and precinct schemes within community associations. With overlapping terminology, informal descriptions, and multiple layers of title, it’s easy for confusion to creep in. This session cuts through the noise to clarify the true legal nature and operation of community and strata schemes, helping practitioners better navigate their complexities. It will cover:

  • The structure and components of community and strata schemes, including the entities they create and how they are managed
  • The interrelationship between community, neighbourhood, precinct and strata schemes
  • The rise of BMCs and SMSs
  • The complexities in respect of the management of Community Associations and BMCs

Matthew is a member of Kerin Benson lawyers’ Building and Construction team. Matthew graduated Laws from UNSW with Honours, and has practiced as a solicitor for over 10 years in commercial law and have acted for and advised clients in a range of matters, including in respect of: property, strata, insurance, contracts, trusts, consumer law, and class actions.

In addition to legal practice, Matthew was a contributor to Wolters Kluwer’s Australian Company Law Commentary and an author to LexisNexis’ Practical Guidance for Total and Permanent Disablement Insurance.

Matthew is an active member of the Law Society of New South Wales and was appointed by the President of the Law Society of New South Wales to: its Business Law Committee since 2021; and its Costs Committee since 2023.
