About the Webinar

The small business restructuring framework offers directors a lifeline to manage financial distress without losing control of their business. But is it the right fit for every situation? With the ATO ramping up efforts to claw back more than $35bn in debt, the number of company directors appointing liquidators to restructure their failing small businesses are likely to significantly increase. This session will explore the framework’s mechanics, benefits, and potential pitfalls to equip advisors with the knowledge to guide their clients effectively. Key topics include:

  • The key features of the small business restructuring framework, including eligibility criteria, process timelines, and how it differs from other insolvency regimes.
  • The role and responsibilities of directors throughout the restructuring process, including how to navigate legal duties and maintain compliance under the Corporations Act.
  • The function of the Small Business Restructuring Practitioner (SBRP), their interactions with directors, and their critical role in facilitating a successful restructuring plan.
  • How to prepare a robust restructuring plan, address creditor concerns, and optimize the chances of acceptance and implementation
  • Case studies of successful and unsuccessful restructurings to identify practical insights, recurring challenges, and strategies for achieving better outcomes
  • The advantages and limitations of the framework, including how to assess whether it’s the best option for a client’s circumstances and how to manage risks effectively
