Case Clinic webinars are a new practical webinar format from TEN designed to work through a detailed real-world scenario from start to finish — examining not just the law, but how issues actually arise in practice. Rather than a traditional technical webinar focused on broad legal principles and a supporting paper, a Case Clinic follows the facts as they unfold, highlighting the decisions, assumptions, timing issues and practical traps that can change the outcome. These sessions are highly practical, discussion-driven and designed to sharpen professional judgment in complex areas.

To mark the launch of this new format, TEN is offering Case Clinic webinars at a special introductory price of $165.

What starts as a straightforward estate planning instruction — “leave the farm to the child who worked it, but be fair to the others” — quickly becomes a complex exercise in balancing control, liquidity and competing expectations. This Case Clinic follows a farming family where most of the wealth is tied up in the land, and the plan must withstand both tax realities and family dynamics. As the facts unfold, you’ll identify the pressure points, test the available structures, and consider what could have been done differently. It covers:

  • A farming couple owns land worth several million dollars, with one child working the farm and others not involved: what are the competing interests from the outset?
  • The initial instruction to transfer the farm to the farming child: is this a gift, or should it be structured to reflect years of contribution?
  • Attempting to “equalise” the other children with limited non-farm assets: what options exist when liquidity is constrained?
  • Considering testamentary trust or staged control structures: do they preserve flexibility or create further tension?
  • The tax overlay, including CGT consequences on death and on any later disposal of the farm: how does tax shape the plan?
  • Pressure from non-farming children for access to value: does the structure force a sale or undermine the business?
  • What happens on death when the plan is implemented: does it achieve the intended outcome or trigger dispute?
  • Where it goes wrong in practice, and the key planning decisions that would have changed the result

Please note that a technical paper will not be available for this case clinic webinar. In lieu of a written paper, attendees will have access to the presenter's detailed PowerPoint slides, which will serve as a comprehensive reference for the session.
