With the housing shortage and cost of living crisis, more and more families are looking into granny flat arrangements as housing solutions for older family members. While a granny flat-type arrangement can offer mutual benefits to multiple generations of the family, there are many aspects of such arrangements that can go wrong if not properly understood or structured right from the beginning. This session shall breakdown the legalities and practicalities of granny flat (and related housing) arrangements and look at:

  • Examples of what can happen when the living-with-family arrangement is not properly structured –
  • Outline how living and financial arrangements of granny-flat type arrangements can impact other financial arrangements, including granny flat exemptions, Centrelink deeming provisions
  • Tips for reducing the risk of disputes or litigation arising in the future including terms/conditions to consider
  • What steps can be taken to protect against elder abuse in these arrangements

Richard McCullagh, Public Service Solicitor, NSW and Author "Australian Elder Law", Thomson Reuters 2018, Lecturer in Elder Law, Gosford, NSW

Richard McCullagh has practised law since 1985, mostly on the Central Coast. He has specialised in elder law since 2012, and continues to do so. He taught Elder Law at the College of Law from 2013 to 2019 and does so at the University of Western Sydney since 2020. His textbook, Australian Elder Law, was published by Thomson Reuters in 2018. He is a past member of the NSW Law Society Elder Law, Capacity and Succession Committee and publishes articles from time to time in the Law Society Journal, amongst others. Richard is currently a government solicitor specialising in elder abuse.
