The criminalisation of coercive control marks a profound shift in how the law understands and responds to patterns of abuse within intimate relationships. While these offences sit in the criminal sphere, their implications are increasingly being felt in family law proceedings, particularly in parenting disputes and the assessment of family violence. This session examines how coercive control concepts are translating into family law practice, the evidentiary and forensic challenges they raise, and what practitioners need to anticipate as courts grapple with overlapping criminal and family law frameworks. It covers:

  • Comparative analysis of coercive control legislation across Australian jurisdictions
  • The elements and scope of coercive control offences: abusive behaviour, intention, penalties, and definitional differences
  • Legislative definitions of abusive behaviour: economic abuse, isolation, deprivation of liberty, and technology-facilitated control
  • Impact on parenting determinations: coercive control as a risk of harm under best interests considerations
  • Proving coercive control on the balance of probabilities in family law proceedings
  • Interaction with apprehended domestic violence orders and family violence provisions
