Drawing on recent decisions, this session highlights what happens when fiduciary duties are ignored or misunderstood, and how practitioners can recognise and respond to the warning signs. This session covers:

  • The financial and legal consequences that arise when executors breach their obligations
  • What risk management requires of practitioners, including when to escalate concerns and how to deal with difficult executors
  • Practical lessons from Re the Estate of Whiteman [2025] VSC 370, Neylon v Iacovino [2025] VSC 511, and Nemler-Aquilina v Mercader [2025] VSC 595

Max is an Accredited Specialist in Wills and Estates Law (NSW) and holds a Master of Laws in this area. He has extensive experience advising clients on estate planning, including the preparation of complex wills, power of attorney documents and discretionary trust succession.  He regularly assists executors in the administration of deceased estates, providing practical guidance on navigating legal obligations with a particular interest in defending Family Provision claims by beneficiaries.

In addition to his advisory practice, Max is a Teaching Fellow at the College of Law, where he lectures in the Wills and Estates subjects within the Master of Laws program.  His academic role reflects his depth of knowledge and commitment to professional education in this field.

Max is a full member of the Society of Trust & Estate Practitioners (STEP), an international body recognising expertise in trusts and estates.  He is also a former editor of de Groot's Wills, Probate & Administration Practice (NSW), a leading practitioner text. This combination of practical, academic and editorial experience places him at the forefront of developments in wills and estates law.
