About the Webinar

More than 70% of parenting applications before the FCFCOA now involve allegations of risk, particularly relating to family violence, child abuse, or neglect. At the heart of the court’s response to such allegations lies the evolving concept of “unacceptable risk.” But what does this term mean in practice, and how is it applied in an increasingly complex social and legal landscape?

This session takes a deep dive into how the unacceptable risk threshold is being interpreted and applied by the courts, including:

  • The evolution of the “unacceptable risk” test: From M v M to recent judicial commentary
  • How courts weigh allegations of risk at the interim versus final hearing stages
  • The influence of the FCFCOA's risk screening process and case management model on how risk is handled procedurally
  • The interplay between family violence evidence, expert reports, and independent children's lawyers in assessing and determining risk
  • Whether the concept of unacceptable risk is shifting in response to broader social understanding of coercive control, trauma, and child development
  • Key takeaways for practitioners when advising clients, and preparing affidavits for matters involving risk allegations
