Now that the 2025 amendments to the Family Law Act have been in operation for over a year, courts and practitioners are grappling with how the new statutory framework operates in practice. This session examines how the codified property settlement pathway is being applied, where judicial discretion remains influential, and which aspects of the reforms are creating uncertainty, risk or unintended consequences. Drawing on emerging case law and courtroom experience, the session explores:

  • How courts are interpreting and applying the codified property settlement framework, including the ongoing influence of Stanford v Stanford
  • The practical impact of the expanded definition of family violence in financial proceedings
  • How wastage, liabilities and housing needs are being weighed under the new “current and future circumstances” factors
  • Early experience with companion animal orders, including limits, evidentiary issues and strategic considerations
  • Statutory disclosure obligations: practitioner risk, compliance challenges and enforcement
  • The extension of the less adversarial approach to property matters and what it means for case management
  • The use of protected confidences provisions and emerging tensions between fairness and privacy

She has written and delivered papers on many areas of family law, and is a regular presenter. 

Evelyn is a member of the Family Law Advisory Committee to the Accreditation Board of the Law Institute of Victoria for Family Law.
