Accountants can often be requested by clients and other parties to provide letters or sign documents for various purposes, or prepare letters to third parties relating to a client or ex client. Whilst an instinctive feeling of wanting to be obliging with those requests may often be felt, it can be a good idea to give each request close examination as to whether obliging is doing the right thing by themselves. This session explores the topic including:

  • The various types of letters and declarations accountants can be requested to complete in practice
  • Dealing with the ethical letter response to another accountant for an outgoing client with red flag issues:
    • are you obliged to convey your concerns to the new accountant?
    • what you can and can’t say

Stephen is a senior lawyer who has been with the firm for many years. He advises clients in many areas of the law including corporate law, corporate governance and risk management, regulatory compliance and regulator enforcement, privacy and data protection, commercial transactions and commercial litigation.

Stephen has been a partner with boutique and mid-tier law firms and was the General Counsel of BDO, Chartered Accountants for five and a half years. He has advised clients operating in many industries including banking and finance, energy, resources and renewables, higher education and training, retail and manufacturing, technology and innovation and professional advisers including auditors and accountants.

Stephen has a keen interest in law reform and in giving of his experience to the profession. He is a member of the Corporations Committee and Insolvency and Restructuring Committees of the Law Council of Australia and is a regular presenter at seminars for lawyers and auditors and accountants. He also lectured at Melbourne University’s Graduate Law School on the subject ‘Shareholders’ Rights and Remedies’.

Stephen has been a practising lawyer for over 35 years in the areas of corporate and commercial law and litigation and dispute resolution and is admitted to practice in Victoria, New South Wales and all Federal jurisdictions.
