About the Webinar

How funds are taken out of a company or trust can have dramatically different tax outcomes. Whether it's a dividend, loan, or capital return — or whether a trust distribution is made to a corporate beneficiary — the label matters. With increased ATO scrutiny and the complexity of Division 7A, Section 100A, and professional firm guidelines, this session unpacks practical strategies and compliance risks when extracting wealth from structures. Topics include:

  • The various methods for withdrawing funds from companies and trusts and the tax consequences of each
  • When seemingly tax-free withdrawals from trusts can inadvertently trigger tax consequences (Section 100A, Subdivisions EA & EB ITAA 1936)
  • Tax tips and traps in practice when:
    • using a company as a beneficiary of a trust to cap tax at the company tax rate
    • extracting retained profits from a company
  • How the ATO are monitoring the extraction of funds from companies and trusts if you are a “professional firm” (PCG 2021/4)
  • Could a restructure assist with tax effectively extracting funds from a company or trust?
  • Is a share buy-back a tax effective option for the SME market?
  • An estate planning approach to leaving company shares to a testamentary trust – what are the tax benefits?
  • A comparison of extracting company funds and deregistering the company versus taking a member's voluntary liquidation approach
