This session is designed to address some of the challenging issues that the margin scheme can throw up, including:

  • When you may need to contact previous owner to obtain details of their purchase to check your own margin scheme eligibility, including:
    • the information you would need to request
    • what to do if you can’t obtain the required information
  • Tips and traps when applying the margin scheme for:
    • the subdivision of broadacres
    • separately acquired lots amalgamated into one title (GSTR 2006/8)
  • Can building work requirements form part of the consideration for the acquisition of land for margin scheme calculations? (WYPF v Federal Commissioner of Taxation [2021] AATA 3050)
