About the Webinar

Holding property in a trust can add an extra layer of complexity to the tax and duty obligations imposed by the states and territories. This session takes a look at why this is, including:

  • How the various states and territories impose:
    • land tax on properties held in a trust
    • duty on properties acquired by a trust
    • duty on an interest acquired in a private landholding unit trust  
  • Issues in practice arising from trust deed amendments restricting foreign persons as potential beneficiaries to avoid:
    • foreign purchaser additional duty
    • surcharge land tax
  • A review of recent case decisions involving trusts and state duties and land tax, including:
    • how the family farm duty exemption applied to the intergenerational transfer of primary production land to a trust (Camwall Pty Ltd atf Antap Trust v Chief Commissioner of State Revenue [2025] NSWCATAD 136)

Megan is a taxation partner in Piper Alderman’s Corporate Team. She has more than 15 years’ experience in State and Federal tax dispute resolution, including having acted for the taxpayer in JMC Pty Ltd v C of T [2023] FCAFC 76). Megan is recognised for her technical expertise and focus on finding solutions that are in line with client objectives.

She has assisted private and public companies, not-for-profit entities, individuals, trusts, partnerships and superannuation funds to navigate and manage State, Federal and inter-jurisdictional tax issues, including:
