About the Webinar

The ATO have included succession planning as one of their targeted focus areas. And with the amount of accumulated wealth expected to be passed on to the next generation in the years ahead, the ATO are no doubt ensuring that any tax applicable on the transfers isn't forgotten. This session looks into the issues attracting the ATO's attention, including:

  • Tips and traps with transferring CGT assets to the next generation, including:
    • the market value substitution rule
    • how the value shifting rules can apply when issuing new shares to the next generation
  • Tax issues with transferring pre-CGT shares or units to the next generation in a company or trust that includes pre and post CGT property (Division 149, ITAA 1997; CGT event K6)
  • Can the small business CGT concessions be a useful tool to use for a tax effective business transfer to the next generation?
  • How family trust and interposed entity elections are impacting on separate structures being set up by the next generation
  • Tax-effective strategies when the matriarch’s and/or patriarch's wealth is tied up in separate structures

Amanda has published articles on trusts, tax and the importance of estate planning, business succession and asset protection.  Amanda has extensive legal knowledge and experience as a lawyer for over 30 years having practised with law firms in the Melbourne CBD for over 25 years but also with a Ringwood firm and Slaughter and May in London.  For the first approximately 10 years of her legal career, Amanda practised as a commercial litigator appearing in the Supreme Court and Federal Court and instructed in London in cases before the High Court and on an appeal to the Privy Council.  For over 20 years, Amanda has practised in commercial law, trusts, tax, asset protection and the importance of estate planning including appearances before the Supreme Court, Family Court and VCAT (Guardianship List) in disputes about control of family wealth in trusts and companies.
