Kate joined the Cleary Hoare team in October 2017 and is based in our Sydney office. She recently completed a combined Bachelor of Laws (Honours) / Bachelor of Commerce (Accounting) at the University of Notre Dame Australia and was admitted as a Solicitor in New South Wales in 2019. Kate has a strong interest in taxation law, having written her Honours thesis on the recently introduced diverted profits tax. During her time at Cleary Hoare, Kate has enjoyed tackling a wide range of complex taxation issues. In her spare time, Kate enjoys singing, attending sporting matches and cooking up a storm.

The taxing principles of deceased estates and testamentary trusts (TTs) follow some of the guidelines that apply to other trusts. However, they also have their own quirks and complexities that practitioners need to be aware of. This session explores some of the issues that arise in practice when dealing with a deceased estate’s or a TT’s tax obligations, including:
- The tax differences between a deceased estate and a TT
- Who pays the tax – executor, trustee or beneficiary?
- The taxing issues relating to the deceased’s main residence
- The tax difference where an asset “passes” to a beneficiary in accordance with a will, or is transferred under a “power of sale”
- Tax issues with:
- introducing assets unrelated to the deceased person into a TT
- a TT borrowing to acquire assets
- Tax issues to address when:
- the deceased is a resident however the executor, trustee or a beneficiary resides overseas
- an inheritance is received from overseas (Sec. 99B ITAA 1936)
